1. Operator and eligibility
TraitLayer is owned and operated by Mind Vault LLC. In these terms, “TraitLayer,” “we,” “us,” and “our” refer to Mind Vault LLC. Contact and company details that must appear in the effective terms are:

You may use TraitLayer only if you are 18 or older, can form a binding agreement where you live, and are permitted to use the service under applicable law. The planned MVP is for English-speaking adults in the United States, Canada, the United Kingdom, Ireland, Australia, and New Zealand. Do not use the service or submit information if you are under 18.
2. What TraitLayer is
TraitLayer is a self-reflection and communication product that turns versioned assessment responses into a private profile, an optional collectible card, and user-controlled context for approved relationship, team, or agent experiences.
The current 26-item instrument is development only and not validated. It uses original placeholder items to test the product contract. Results describe current responses within that experimental instrument. They are not diagnoses, clinical advice, aptitude measures, fixed human types, population norms, predictions, certifications, or statements of fact about identity or ability.
Form, Drive, and Tempo are a creative presentation of continuous response dimensions. No Form is better, rarer, more employable, more compatible, or more powerful than another. AI may help write optional narrative or generate visual surroundings, but AI does not calculate or alter deterministic scores.
3. Accounts and sign-in
The planned primary sign-in method is Google. Passwordless email is the planned fallback and recovery method, with an optional passkey after a verified sign-in. TraitLayer will not offer passwords or SMS in the MVP.
You agree to:
- provide information you are authorized to use and keep your recovery method current;
- protect your device, browser session, email account, passkey, and one-time links;
- not share a private session, upload, account, invitation, embed, or agent credential;
- notify TraitLayer promptly through [SECURITY CONTACT TO BE ADDED] if you suspect misuse; and
- use explicit account linking rather than creating misleading or duplicate identities.
TraitLayer may require a fresh sign-in for deletion, sign-in-method changes, agent credentials, purchases, or another high-impact action. We may suspend a credential or account to contain a security or abuse risk, investigate a legal request, or enforce these terms. The effective terms must state notice, appeal, and termination procedures.
4. Your content and your profile
You retain whatever rights you have in answers, free text, names, photos, and other material you submit. TraitLayer treats the person described by a profile as the sole authority who may approve that profile's publication. A friend, Circle host, manager, company administrator, or payer does not gain ownership or publication control.
You give Mind Vault LLC a limited license to host, process, reproduce, transform, and display submitted content only as needed to provide the features you request, secure and support the service, follow your publication choices, and meet applicable legal obligations. A public publication also permits TraitLayer to distribute the exact approved artifact until it is revoked or expires. This license does not permit advertising use or model training on private profiles, free text, or photos.
You promise that you have the rights and permissions needed for content you submit, that a photo upload depicts you, and that it does not include another person. You must not upload confidential information belonging to an employer, client, or another person.
A retest creates a new private profile version. It never updates an existing share, Pair Card, Work Card, Team Deck, Circle projection, or agent grant automatically.
5. Sharing, Pair Cards, and public Team Decks
Profiles are private by default. Sharing requires a separate, version-pinned approval. Exact scores and raw answers remain private unless a future feature provides a clear, lawful, owner-controlled choice. Pair Cards require both adults to approve the same preview. Work Cards and public Team Deck tiles remain member-controlled.
A public card or Team Deck embed is public and may be scraped, copied, downloaded, screenshotted, archived, or cached by others. Revocation removes the live TraitLayer version and we will purge caches we control where possible. It cannot force another person or service to delete a copy already outside our control.
A free Team Deck may show up to five member-approved cards and a persistent “Powered by TraitLayer” footer. A paid plan may change branding but never changes member consent, private-data access, or the prohibited workplace-use rules. A company may control its verified domain and ordinary presentation details. It may not edit, republish, or restore a member's personality highlights.
6. Photos and generated media
Photo features are for a self-photo of one adult account holder. You must attest that the image depicts you, that you have the right to use it, and that no third-party photo is included. TraitLayer may reject an upload for safety, file-integrity, one-face, moderation, consent, or operational reasons.
The default True Face mode preserves the real face while TraitLayer composes it into an original, personless fantasy environment. A full-likeness redraw is a separate opt-in and remains disabled until its provider, retention, regional, safety, and review gates pass. Generated images and videos can contain visual errors or unexpected details. You must review and approve an output before publication.
TraitLayer-controlled source and sanitized face photos must be deleted immediately after processing finishes or fails, and always within 24 hours after upload. The effective terms and Privacy Notice must disclose any narrow provider safety or legal-retention exception before a photo can leave TraitLayer's controlled pipeline.
Rejected or unapproved generated candidates are retained only for the approved review window. Purchased output is intended to remain available after a subscription ends until the owner deletes it, subject to final purchase terms and lawful recordkeeping. The owner may delete generated assets separately from the minimal payment record.
You may not present generated media as documentary proof, use it to deceive or impersonate another person, remove required development or provenance labels, or use it in a way that violates another person's rights.
7. Acceptable and prohibited use
You may use your own profile for adult self-reflection, communication, mutual relationship exercises, member-approved team development, and consent-scoped agent context.
You must not use TraitLayer data, inferences, publications, embeds, exports, APIs, or agent tools to make or recommend:
- hiring or applicant-screening decisions;
- promotion, compensation, or performance-evaluation decisions;
- task, shift, client, territory, or project allocation;
- retention, termination, layoff, or succession decisions;
- ranking, sorting, filtering, or scoring people for workplace opportunity;
- clinical diagnosis, treatment, crisis assessment, or medical decisions;
- credit, insurance, housing, education-admission, legal, immigration, or public-benefit decisions; or
- covert persuasion, manipulation, surveillance, or targeting based on psychological traits.
A stated team-development purpose, payment, account role, valid token, public URL, or company contract does not permit a prohibited decision.
You also must not:
- access another person's private data or bypass consent, authentication, rate limits, safety controls, or revocation;
- infer protected characteristics from a photo or profile;
- upload malware, hostile files, unlawful material, or third-party photos;
- harass, threaten, discriminate against, dox, impersonate, or exploit another person;
- use bots to scrape private or access-controlled surfaces, test credentials, or create abusive load;
- misrepresent a development result as validated, diagnostic, predictive, or endorsed by an employer or clinician;
- copy TraitLayer's proprietary art, card system, software, trademarks, or trade dress except as applicable law expressly permits; or
- use the service in violation of law or another person's rights.
TraitLayer may refuse a request, withhold an output, revoke a credential, remove content, or suspend an account when reasonably necessary to enforce these boundaries. Payment never requires TraitLayer to fulfill a prohibited or unsafe request. The effective refund policy must explain the result if payment has already been accepted.
8. Purchases, Stripe, tax, and refunds
The planned paid MVP offers are a $19 USD Portrait Edition and a $29 USD Cinematic Edition, each as a one-time purchase through Stripe-hosted Checkout. Mind Vault LLC, not Stripe, is the merchant and seller. Stripe processes the payment and may perform fraud, compliance, and payment-network functions under its own terms and privacy notice.
Before you pay, the checkout must show the exact offer, price, currency, included output, generation allowance, tax if applicable, delivery expectations, and applicable purchase and refund terms. A checkout success page is not proof of payment. Access begins only after an authenticated payment event is recorded. Payment grants an entitlement to the purchased feature, not access to another person's profile, consent, or publication rights.
Refund policy is pending.

No paid transaction should be accepted until this policy is complete, presented before checkout, and reconciled with mandatory consumer guarantees, cancellation rights, and digital-content rules in each launch market.
Taxes may be charged only as configured for registrations Mind Vault LLC actually holds and as applicable law requires. Ordinary Stripe does not make Stripe the merchant of record and does not remove Mind Vault LLC's tax, consumer-disclosure, refund, support, or dispute responsibilities.
Nothing in these terms excludes, restricts, or modifies a consumer guarantee, refund right, cancellation right, or other statutory protection that cannot lawfully be excluded. If this draft conflicts with a mandatory right, that right controls.
9. TraitLayer intellectual property and the CC0 boundary
Mind Vault LLC owns TraitLayer's brand, application software, product designs, original collectible universe, character and archetype expression, card art, animations, templates, narrative system, and other proprietary content, except for user content, third-party materials, and any artifact later released under an explicit public license.
The current placeholder instrument, draft items, scoring research, and unreleased instrument versions are not public domain and are not CC0. A future validated short form becomes CC0 only when Mind Vault LLC publishes an explicit release artifact naming the immutable version, item set, scoring specification, provenance record, and CC0 dedication. That later release does not place the TraitLayer brand, software, private data, card universe, art, or narrative engine in the public domain.
You may refer accurately to TraitLayer, but you may not imply sponsorship, endorsement, certification, or affiliation. Any final trademark-use policy will govern use of the TraitLayer name and marks alongside a future CC0 instrument.

10. Privacy, export, deletion, and account closure
The Privacy Notice draft describes the planned handling of personal information. It is separate from these terms and must become an approved effective notice before real-data launch.
Profile export, publication revocation, and account deletion are intended to remain free. Account deletion revokes live publications and credentials, cancels queued work, removes product data and requested generated assets under the deletion schedule, and closes sign-in methods and sessions. Minimal payment, security, legal, or irreversible deletion evidence may remain only where the final notice and applicable law permit it.
Deleting an account cannot recall public downloads, screenshots, mirrors, or third-party caches. It also cannot remove data another service controls under its own legal duties. TraitLayer must explain those limits at deletion and publication time.
11. Service changes, suspension, and ending the service
TraitLayer may change, test, limit, suspend, or discontinue a development feature. Material changes to a paid feature must follow the final purchase terms and applicable consumer law. TraitLayer may preserve owner access to a purchased output after subscription cancellation while ending access to ongoing subscription features.
If we suspend or close an account, the effective terms must provide any required notice, reason, appeal, export period, purchased-output access, and refund remedy. Immediate action may be necessary for a credible security threat, unlawful content, harm, or repeated prohibited use.
12. Warranties and disclaimers
TraitLayer is an experimental self-reflection product. Results may be incomplete, inaccurate, unstable, or unsuitable for a particular purpose. Generated media may contain artifacts or unexpected details. The service is not medical, mental-health, employment, legal, tax, financial, or other professional advice.
To the fullest extent applicable law permits, the service and development content are provided “as is” and “as available” without warranties of accuracy, validation, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. This language does not exclude any warranty or consumer guarantee that cannot lawfully be excluded.
13. Liability and indemnity

No liability term may excuse intentional wrongdoing, misuse of sensitive profile or likeness data, a responsibility that cannot lawfully be limited, or a mandatory consumer remedy. No paid launch should occur while this section remains unresolved.
14. Governing law and disputes

The effective terms must preserve any mandatory right to bring a claim, use a local consumer forum, or rely on the law of a person's country that cannot be changed by contract. This draft does not select arbitration, waive a jury, select a forum, or claim that any one law applies.
15. General terms
The effective agreement may include order-specific purchase terms, a Privacy Notice, and clearly incorporated feature rules. If an order term conflicts with these general terms, the effective agreement must explain which controls. A failure to enforce one term is not automatically a waiver. If a term is unenforceable, the remaining terms should continue only to the extent applicable law permits.
Mind Vault LLC may assign the agreement only as the effective terms and applicable law allow, with any required notice and continued protection for personal information. You may not transfer an account or publication authority to another person.
16. Contact and effective-version requirements

The approved terms must show an effective date and version and must be presented at the relevant signup and checkout surfaces. A material change must not silently broaden an existing consent, publication, research, likeness, or agent-access choice.
